This issue paper is the result of an intense collaboration among the privacy professionals of GPIQWG and esteemed biometric, DNA, and familial DNA searching subject-matter experts (SMEs) who generously contributed their time and expertise to its content and development. GPIQWG, on behalf of Global, developed this overview to support state, local, and tribal (SLT) justice entities that are performing or considering performing familial DNA searching with a primer on the science of familial DNA and its use in criminal investigations, key issues implicated by familial DNA searching, and guidance on balancing the interests of both law enforcement and public safety with the privacy rights, interests, and concerns of affected persons.

The Privacy, Civil Rights, and Civil Liberties Policy Development Template for State, Local, and Tribal Justice Entities (SLT Policy Development Template) was developed to assist SLT agencies in drafting a privacy policy. The provisions suggested are intended to be incorporated into the agency’s general operational policies and day-to-day operations. Each section represents a fundamental component of a comprehensive policy that includes baseline provisions on information collection, information quality, collation and analysis, merging, access and disclosure, redress, security, retention and destruction, accountability and enforcement, and training. Sample language is included for each recommended provision.

Criminal Intelligence Resources Guide

The U.S. DOJ’s Global Advisory Committee, its working groups, and partner organizations have developed many valuable resources to assist practitioners in improving agency operations and criminal intelligence sharing efforts. However, to centrally locate these resources in an easily accessible format/venue and provide a single reference to “all things intelligence” is an ongoing goal and challenge. The Criminal Intelligence Resources Guide (“Guide”) was created to address this need. This compendium of intelligence products was prepared under the guidance of the Criminal Intelligence Coordinating Council (CICC) and its research arm, the Global Intelligence Working Group, providing a well-balanced approach not only to the content and organization of the Guide itself but to the many resources included. While the Guide does not claim to be the all-encompassing intelligence resource, it does aim to capture a valuable representation of the related tools available to the justice community. This is a “living document,” and persistent efforts will be employed to continually update it as new resources are identified.

The booklet Law Enforcement Analytic Standards discusses the standards created by the International Association of Law Enforcement Intelligence Analysts (IALEIA) as a result of the National Criminal Intelligence Sharing Plan (NCISP) recommendations. The analytic standards consist of 25 standards that explain the requirements of agencies to adopt the minimum standards for intelligence-led policing in order to support the development of sound, professional, and analytical products (intelligence). The standards are composed of educational standards and intelligence process standards, as well as testimony, data-source attribution, and feedback standards.

The spec also defines a set of processes by which the GFIPM Cryptographic Trust Fabric document is created, distributed, and updated based on changes in federation membership. Global Privacy Resources Booklet

Thanks to the great work by the U.S. Department of Justice's (DOJ) Global, Global partners, and through DOJ collaborations with other federal agencies, there are a variety of privacy awareness, policy development, and implementation products available to the justice community today. To help these agencies know “which” privacy product(s) to use “when” and for “what purpose,” Global has published a roadmap for navigating through these resources in a Global Privacy Resources booklet. The road map graphically illustrates the stages an agency naturally goes through when embarking on such an endeavor, (such as education and awareness, self-assessment, policy development, technical implementation, and training). Each of these stages, together, comprises a Privacy Program Cycle. The Global Privacy Resources booklet graphically illustrates every stage of this cycle and guides agencies to the resources they need for each particular stage. Global recognizes that State, Local, and Tribal (SLT) justice entities come in all sizes, with a variety of roles and with varying degrees of available resources. The resources presented in this booklet are flexible and designed to meet a spectrum of privacy protection needs. This compliance verification document assists intelligence enterprises in complying with all applicable privacy, civil rights, and civil liberties protection laws, regulations, and policies. As a “next step” for agencies that have completed and implemented protections established in the privacy policy, the checklist evaluates agency compliance with the policies and procedures and helps to uncover any gaps that may need to be addressed. The checklist provides a suggested methodology for conducting the review of an agency’s intelligence enterprise and identifies the high-liability areas of concern that should be included when performing the review. Guidance for Building Communities of Trust

This resource—developed by Robert Wasserman in collaboration with the Office of Community Oriented Policing Services (COPS), DOJ, and DHS—focuses on developing relationships of trust among law enforcement, fusion centers, and the communities they serve, particularly immigrant and minority communities, so that the challenges of crime control and prevention of terrorism can be addressed. Trust, transparency, and the protection of privacy, civil rights, and civil liberties are fundamental to effective crime control, and these principles must serve as the foundation for information and intelligence sharing efforts intended to support crime prevention and terrorism prevention activities. Through a series of facilitated sessions, the Building Communities of Trust (BCOT) effort convened privacy, civil rights, and civil liberties groups; community leaders; and law enforcement officials for an intensive dialogue. The program’s objective is to help communities understand how law enforcement is using information to protect neighborhoods and citizens, while at the same time educating law enforcement on the priorities and needs of residents and how various community members view law enforcement efforts. The resulting guidance provides advice and recommendations on how to initiate and sustain trusting relationships that support meaningful sharing of information, responsiveness to community concerns and priorities, and the reporting of suspicious activities. Building and maintaining trusting relationships between communities and law enforcement to prevent acts of crime and terrorism is the overarching theme of this document.

Criminal intelligence plays a vital role in the safety and security of our country. The Code of Federal Regulations, Title 28, Part 23—Criminal Intelligence Systems Operating Policies (or 28 CFR Part 23) was issued in 1980 to ensure the privacy and constitutional rights of individuals during the collection and exchange of criminal intelligence information, and it has since been an important part of the intelligence landscape. 28 CFR Part 23 is a guideline for law enforcement agencies that operate federally funded multijurisdictional criminal intelligence systems. To facilitate greater understanding of 28 CFR Part 23, the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice, developed the Criminal Intelligence Systems Operating Policies (28 CFR Part 23) online training, which focuses on the requirements of 28 CFR Part 23 and includes topics such as compliance, privacy, inquiry, and dissemination requirements; storage requirements; and review-and-purge requirements. Protecting individual privacy is a fundamental responsibility of justice agencies that collect and share personally identifiable information. Privacy policies articulate appropriate collection of and allowable uses for information, as well as, provide accountability for misuse. Comprehensive privacy policies serve as a fundamental lynchpin to developing a system of trust that allows agencies to share personally identifiable and other sensitive information. Though there is considerable need for states and local agencies to develop privacy policies, agencies have been slow to develop them, preferring to remain reactive rather than proactive. The Global Privacy Policy Statement was developed, on behalf of the U.S. Department of Justice (DOJ), as a joint effort between the Global Privacy and Information Quality Working Group (GPIQWG) and the Global Outreach Working Group (GOWG). This Global declaration makes a strong statement to encourage states and local agencies to develop privacy policies. Furthermore, states are strongly encouraged to take a leadership role by providing assistance to local and tribal agencies in the development of statewide model privacy policies or policy development templates consistent with Federal and State law.

The Importance of Privacy, Civil Rights, and Civil Liberties Protections in American Law Enforcement and Public
Safety training video assists local, state, and tribal law enforcement line officers in understanding their role in the protection of privacy, civil rights, and civil liberties as they perform their everyday duties. The video provides an introductory overview of what privacy, civil rights, and civil liberties protections are; examples of these protections; and the important function line officers have in upholding these protections. The short video may be used during roll call and in-service training, incorporated into agency distance-learning capabilities, and used to complement other agency privacy-related training efforts.

This document offers an overview of the National Criminal Intelligence Sharing Plan (NCISP). The NCISP, the first of its kind in the country, provides a blueprint to help agencies establish criminal intelligence sharing policies, procedures, standards, technologies, and training. The Plan was assembled with close input and cooperation from local, state, tribal, and federal law enforcement agencies, and it has been endorsed by numerous national law enforcement organizations. Implementation of NCISP will provide law enforcement agencies with the ability to gather, analyze, protect, and share information and intelligence to identify, investigate, prevent, deter, and defeat the perpetrators of criminal and terrorist activities, both domestically and internationally.

The Fusion Center Privacy Policy Development: Privacy, Civil Rights, and Civil Liberties Policy Template was developed in collaboration with the DHS/DOJ Fusion Process Technical Assistance Program and DOJ’s Global Privacy and Information Quality Working Group (GPIQWG). This template assists fusion center personnel in developing a center privacy policy related to the information, intelligence, and suspicious activity report (SAR) information the center collects, receives, maintains, archives, accesses, and discloses to center personnel, governmental agencies, Information Sharing Environment (ISE) participants, and other participating criminal justice and public safety agencies, as well as to private contractors and the general public. Provisions contained in this template will help centers comply with requirements of the DHS’ Homeland Security Grant Program Guidance, the ISE Privacy Guidelines, and the National Suspicious Activity Reporting (SAR) Initiative.

This CD provides a narrated overview of the National Criminal Intelligence Sharing Plan (NCISP). The NCISP, the first of its kind in the country, provides a blueprint to help agencies establish criminal intelligence sharing policies, procedures, standards, technologies, and training. The Plan was assembled with close input and cooperation from local, state, tribal, and federal law enforcement agencies, and it has been endorsed by numerous national law enforcement organizations. Implementation of NCISP will provide law enforcement agencies with the ability to gather, analyze, protect, and share information and intelligence to identify, investigate, prevent, deter, and defeat the perpetrators of criminal and terrorist activities, both domestically and internationally.

Many justice and public safety organizations have been working to define information exchanges, conformant with the Global Justice XML Data Model (Global JXDM), to be used within their information sharing enterprise. Recently, a number of justice practitioner and industry organizations have been working to define ''reference'' information exchanges, intended as models for information exchanges that meet specific business needs. The Global XML Structure Task Force (GXSTF) recognized the need to identify and describe a common set of artifacts to document the structure and content of a Global JXDM-conformant XML instance used in an information exchange to meet a specific business purpose. This set of artifacts is referred to as ''Global JXDM Information Exchange Package Documentation.''

GTTAC, GXSTF, and the XML Advisory Committee have made the recommendation for this paper to become the accepted terminology for characterizing information exchange solutions using the Global JXDM. The Office of Justice Programs (OJP) has accepted this recommendation.

Global JXDM Implementation Guidelines

This resources lists informal conformance requirements for Global JXDM compliance. The Global JXDM is a reference model. This means it is not a rigid standard that must be used exactly as it is in its entirety. The Global JXDM was designed as a core set of building blocks that are used as a consistent baseline for creating exchange documents and transactions within the justice community. While an XML schema rendering of the entire model exists, it is not a requirement for Global JXDM compliance that this entire schema be used for validation.

Building Exchange Content Using the Global JXDM: A User Guide for Practitioners and Developers

Integral to the success of the Global Justice XML standards effort is the promulgation of written guidelines to facilitate Global JXDM implementation by the justice community. The Bureau of Justice Assistance (BJA), Office of Justice Programs (OJP), U.S. Department of Justice (DOJ), awarded a grant to SEARCH, The National Consortium for Justice Information and Statistics, to provide Global JXDM technology assistance and to develop a User Guide to support Global JXDM implementation. A Global JXDM User Guide Review Committee, comprised of subject-matter and industry experts, was formed to develop this guide. As a result, Building Exchange Content Using the Global Justice XML Data Model: A User Guide for Practitioners and Developers is now available for users at all levels of technical proficiency and Global JXDM implementation readiness. While this User Guide is not a primer on XML or data processing, BJA, in developing the outline, realized that the guide needed to reach a broad audience. Through its experience in providing technical assistance over the past year, BJA discovered that agencies and jurisdictions are at varying levels of readiness with respect to implementing the Global JXDM. As a result, the guide was developed for those at the evaluation and exploration stage, as well as for those who have incorporated XML into their systems' architecture but still need instruction and examples defining information exchange packages, queries, and messages.

The eight Fair Information Principles (FIPs) contained within this Organization for Economic Cooperation and Development (OECD) document were developed around commercial transactions and the trans-border exchange of information. Operating under the guidance and support of the Bureau of Justice Assistance (BJA), Office of Justice Programs (OJP), U.S. Department of Justice (DOJ) the Global Justice Information Sharing Initiative (Global) Advisory Committee (GAC) held its spring 2007 meeting on April 18, 2007. The GAC is a Federal Advisory Committee to the highest-ranking justice officer in the nation-the U.S. Attorney General (AG)-on justice-related information sharing issues. The event took place at the Sheraton Crystal City Hotel, 1800 Jefferson Davis Highway, Arlington, Virginia. This was the first GAC meeting presided over by Chairman Robert Boehmer, GAC member representing the National Criminal Justice Association (NCJA), who was elected to Global leadership in November 2006. At that same time, Colonel Bart Johnson, GAC member representing the International Association of Chiefs of Police (IACP)-Division of State and Provincial Police and the Criminal Intelligence Coordinating Council (CICC), was elected Committee Vice Chair. This summary carefully describes, in detail, the business that transpired during the GAC meeting and includes a listing of members present and the meeting's working agenda. The GAC meets twice a year, in the spring and fall, in the Washington, DC, area. These events are open to the public and announced in the Federal Register.

This resource provides detailed information on customized schema subsets. Since the full justice schema and all of its imports are optional and over-inclusive, users have the ability to retrieve only those components from the data dictionary that they need. Many users will not want every element to be able to occur repeatedly. Furthermore, it is unlikely that a user will need to use the entire contents of the full schema. This is the basic idea behind schema subsets--to provide smaller schemas that define only those components from the dictionary that the user wants to include. Smaller schema subsets can be more manageable than the full schema and will usually permit more rapid validation of document instances.

XML schema provides two constructs for tagging data in XML instances: attributes and elements. Properties can be represented by either construct. GISWG is implementing a coordination process to identify information sharing standards within the justice community.
